McDonald suspended his decision for six months to give Parliament a chance to respond. The agreement is maintained during this period. Under the Safe-Third Country (STCA) agreement, asylum seekers arriving in an official Canada-U.S.-U.S. crossing point, which goes both directions, is returned and invited to seek asylum in the first country they arrived in. At the recent hearing before Stratas J., counsel for this group argued that the government`s assertion that there would be an “increase” in new asylum seekers at the border if the agreement was struck down was “speculative” and “hypothetical”. Ottawa is appealing a court decision that overturned a major refugee deal between Canada and the United States, Public Safety Minister Bill Blair said Friday. The government has repeatedly stated that it is negotiating with the United States to “modernize” the safe third country agreement, but has never explained what this means and whether any changes to the agreement would prevent people from filing asylum claims after crossing the border between official ports of entry.
Federal Judge Ann Marie McDonald ruled that the agreement violated part of the Canadian Charter of Rights that states that laws or actions of the state that encroached on life, liberty and security must be consistent with the principles of fundamental justice. On January 30, 2017, critic Jenny Kwan of the New Democratic Party (PND) of IMMIGRATION, refugees and citizens of Canada (IRCC) proposed an emergency debate on “President Trump`s immigration and travel ban from seven countries in the Middle East and North Africa.”  During the debate, the NDP called on the government to immediately suspend the agreement on the security of third-country nationals, citing the fact that “Canada can no longer trust that the U.S. refugee system provides refuge for those at risk of persecution.”  The official Conservative Party of Canada has stated that it will not oppose the suspension of the agreement, while the Green Party of Canada has expressed support for the suspension of the agreement.  The government appealed McDonald`s decision and argued that if the border agreement were overturned, there would be “irreparable harm” to the rule of law and the common good. The Canadian Refugee Council strongly opposes this agreement because the United States is not a safe country for all refugees.
